These Terms of Use are an agreement between you and BiteSage ("we", "us") about your use of the BiteSage mobile application and the related website (together, the "Service"). By creating an account, or by continuing past the welcome screen, you accept these Terms. If you do not accept them, please do not use the Service.
Our Privacy Policy explains what we do with your data and forms part of these Terms.
1. Medical disclaimer — please read this first
BiteSage is not a medical device, and it does not provide medical advice, diagnosis or treatment.
- BiteSage offers general nutrition information and estimates. It does not replace a doctor, a dietitian, or any other qualified healthcare professional.
- Calorie and macronutrient targets are calculated from population-level formulas applied to the profile you entered. They are a starting point, not a prescription. Your real needs depend on factors the app cannot know.
- Nothing in the app — including anything the in-app assistant says — should be read as a diagnosis, as a treatment plan, or as a reason to start, stop or change any medication or medical treatment.
- Talk to a healthcare professional before using BiteSage, and before acting on anything it shows you, if you are pregnant or breastfeeding, if you are under 18, if you have diabetes, kidney disease, heart disease, thyroid disease, a food allergy or intolerance, any other chronic condition, or if you are taking prescribed medication.
- If you have, or have ever had, an eating disorder — or if calorie tracking makes you anxious — please speak to a professional before using this or any other tracking app. BiteSage deliberately avoids judgemental language and never labels food as "good" or "bad", but counting calories is not right for everyone. You can hide calorie figures in Settings, and you can delete your account at any time.
- In an emergency, call your local emergency number. Do not rely on this app.
Allergen warnings shown by the app are generated from an automated estimate and may be incomplete or wrong. Never rely on BiteSage to decide whether a food is safe for you if you have a food allergy. Always check the actual product packaging and ask the person who prepared the food.
2. AI estimates are estimates
BiteSage uses artificial intelligence to recognise food from a photo, a written description, a spoken description or a barcode, and to estimate its nutritional content.
- These estimates are approximate and can be wrong. Recognition can misidentify a food; portion size estimated from a photo is inherently uncertain; hidden ingredients such as cooking oil, sugar or sauce may be missed.
- That is why the app shows a calorie range together with separate confidence scores for recognition and for portion, and asks you clarifying questions instead of presenting a single confident number.
- It is your responsibility to review and correct every estimate before you save it. The app stores the AI's first estimate and your confirmed version separately, precisely so that the difference stays visible.
- Nutrition values come from public and licensed food databases and from AI estimation. We do our best to keep them accurate, but we do not warrant that any value is correct, complete or current.
- The AI features depend on third-party model providers and may be temporarily unavailable, rate-limited or degraded. You can always log a meal manually.
3. Who may use BiteSage
You must be at least 13 years old — or 16 if the law of your country sets that higher age for consent to online services — to use BiteSage. We enforce a minimum age of 13, and 16 in EEA countries whose national law requires it. If you are under 18, use BiteSage only with the involvement of a parent or guardian.
You must have the legal capacity to enter into this agreement, and you must not be barred from using the Service under the laws that apply to you.
4. Your account
- You may use BiteSage as a guest, with your data kept on your device, or create an account so your diary syncs across devices and survives a lost phone.
- You are responsible for keeping your login credentials secure and for everything done through your account. Tell us at burakaltan885@gmail.com if you believe someone else has access to it.
- The information you enter — your age, height, weight, goals, allergens — drives the calculations. Please keep it accurate. BiteSage cannot tell when a value is wrong.
- One account is for one person. Do not share an account.
5. Free plan, subscription, and how billing works
BiteSage offers a free plan with limited features and a paid subscription ("BiteSage Premium") that unlocks the rest. Premium unlocks unlimited AI photo analysis, voice logging, natural-language text logging beyond the free daily allowance, the AI assistant beyond the first 3 messages, the adaptive plan, and the advanced weekly insights (fibre trend, weight trend, frequent foods, meal timing and the weekly suggestion). On the free plan you get 1 AI photo analysis and 3 text analyses a day; manual logging, barcode scanning, daily macros, weight and hydration tracking and your basic history stay free and unlimited.
5.1 Billing is through the store
Payment is taken by Apple (App Store) or Google (Google Play), not by us. When you subscribe, the charge is applied to your App Store or Google Play account at confirmation of purchase. We never see or store your payment details.
5.2 Automatic renewal
Subscriptions renew automatically. Your subscription continues, and your store account is charged the then-current price for the next period, unless you turn off auto-renewal at least 24 hours before the end of the current period. Renewal is charged within the 24 hours before the period ends.
The price, the billing period and the total amount charged are shown on the subscription screen before you buy, and the automatic renewal notice is always visible there.
5.3 Free trial, where offered
If a free trial is offered, it is stated explicitly on each plan before you buy — including that billing begins automatically when the trial ends unless you cancel at least 24 hours before that. Any unused portion of a free trial is forfeited if you buy a subscription during the trial. Trials are usually limited to one per user or per store account, and eligibility is determined by the store.
5.4 Cancelling
Cancel from your store account, not from inside BiteSage — we cannot cancel a store subscription for you.
- iOS: Settings → your name → Subscriptions → BiteSage → Cancel Subscription.
- Android: Google Play → profile icon → Payments & subscriptions → Subscriptions → BiteSage → Cancel.
Cancelling stops the next renewal. You keep Premium access until the end of the period you already paid for.
Deleting your BiteSage account does not cancel your subscription. Cancel in the store first.
5.5 Refunds
Purchases are made through the stores, so refunds are handled by Apple and Google under their own policies, and we cannot issue them. Request a refund at reportaproblem.apple.com (Apple) or through Google Play's refund process.
If you are a consumer in the European Union, the United Kingdom or Türkiye, you have a statutory right of withdrawal for distance contracts — 14 days in the EU/UK, and the right of withdrawal under Turkish consumer legislation. For digital content delivered immediately, that right may end once performance begins with your consent. Where a statutory right of withdrawal applies to a purchase made through a store, exercise it through that store; we will support a valid request. Nothing in this section limits your mandatory consumer rights.
5.6 Price and plan changes
We may change prices or what is included in a plan. A price change never applies to a period you have already paid for. Where a change affects a renewal, you will be told in advance in the app or by the store, and you can cancel before it takes effect.
5.7 Restoring purchases
If you reinstall the app or switch devices, use Restore purchases on the subscription screen to recover an active subscription tied to your store account.
6. Acceptable use
Please do not:
- use BiteSage for anything unlawful, or in a way that infringes anyone else's rights;
- upload photos or text containing other people's personal data, sexual content, violence, or anything illegal — the camera is for your food;
- attempt to reverse-engineer, decompile, or extract the source code or models behind the Service, except to the extent that this cannot lawfully be prohibited;
- scrape, bulk-download or resell our food database or any other Service content;
- send automated, abusive or excessive requests, circumvent scan limits or subscription checks, or otherwise interfere with the Service or its infrastructure;
- use the Service to build a competing product, or to train a machine learning model on our outputs;
- misrepresent yourself, or use another person's account.
We may suspend or terminate an account that breaks these rules, with notice where it is reasonable to give notice.
7. Your content
You keep ownership of everything you put into BiteSage: your photos, notes, entries and corrections ("Your Content").
You grant us a limited, worldwide, royalty-free licence to host, store, reproduce and process Your Content only to the extent needed to operate the Service for you — for example to store a photo in your diary, to send it to an AI provider for the analysis you requested, or to include it in a data export you asked for. This licence ends when you delete the content or your account.
We will use Your Content to train or improve AI models only if you have switched on the separate "Help improve the model" permission, which is off by default. See the Privacy Policy, section 6.
You confirm that you have the right to upload what you upload.
8. Our intellectual property
The Service — the app, its design, its text, its logos, its food database compilation and its underlying software — belongs to us or our licensors and is protected by copyright, trade mark and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own personal, non-commercial use. All rights not expressly granted are reserved.
Third-party components (including open-source libraries) are used under their own licences; a list is available in the app's About screen or on request.
"BiteSage" and the BiteSage logo are our trade marks. \"BiteSage\" and the BiteSage logo are unregistered trade marks; no trade-mark application has been filed to date.
9. Availability, changes and termination
- We try to keep the Service running, but we do not promise uninterrupted or error-free availability. We may take the Service down for maintenance, and we may change, add or remove features.
- We may put the app into a maintenance mode, or disable an individual feature, when necessary to protect the Service.
- You can stop using BiteSage at any time and delete your account from Settings → Privacy and security → Delete my account.
- We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. If we discontinue the Service we will give reasonable notice and a chance to export your data.
- Sections that by their nature should survive termination — including sections 1, 2, 7, 8, 10, 11 and 12 — do survive.
10. Warranties
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all implied warranties, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. In particular, we do not warrant that nutrition values, AI recognition results, calorie targets or allergen warnings are accurate or complete.
If you are a consumer, this section does not affect the rights you have under mandatory consumer protection law, including the Turkish Consumer Protection Law No. 6502 and equivalent EU and UK legislation. Those rights apply in addition to, and prevail over, anything in these Terms that would reduce them.
11. Limitation of liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profit, revenue, goodwill or data, arising from your use of, or inability to use, the Service.
- We are not liable for any health outcome, dietary decision, weight change, allergic reaction or other consequence that results from relying on estimates, targets or information shown by the Service. You use BiteSage at your own risk and remain responsible for your own health decisions.
- Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, your mandatory statutory rights are unaffected.
12. Disputes
Please write to us at burakaltan885@gmail.com first. Almost everything is settled faster that way than through any formal route.
If you are a consumer, nothing here takes away the protection of the mandatory law of the country you live in, and you may bring proceedings in the courts of your own country. Consumers in Türkiye may apply to the district or provincial Consumer Arbitration Committee (Tüketici Hakem Heyeti) or to the Consumer Court, within the monetary limits set each year. Consumers in the EU may use the European Commission's online dispute resolution platform at <https://ec.europa.eu/consumers/odr>.
13. Apple and Google
These Terms are between you and us, not with Apple or Google.
- Apple and Google are not responsible for the Service or its content, and have no obligation to provide maintenance or support for it.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.
- You confirm that you are not located in a country subject to a relevant embargo, and that you are not on a prohibited-parties list.
- Your use of the App Store or Google Play is also governed by their own terms.
14. Changes to these Terms
We may update these Terms. We will post the new version here and raise the version number. For material changes we will notify you in the app before they take effect. If you continue using the Service after that, the new Terms apply. If you do not accept them, stop using the Service and, if you wish, delete your account.
15. General
- If a provision is found unenforceable, the rest stays in force.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign these Terms; we may assign them as part of a merger, acquisition or sale of assets, without reducing your rights.
- These Terms, together with the Privacy Policy, are the entire agreement between us about the Service.
- In case of conflict between translations, the English version prevails prevails.
